Files lawsuit on Beaverhead Deerlodge National Forest Plan revision.

On Thursday, December 23, 2010, Citizens for Balanced Use (CBU) filed litigation against the Forest Service on their Forest Plan Revision of the Beaverhead Deerlodge National Forest.

The CBU complaint alleges the Forest Service did not comply with the National Environmental Policy Act, the National Environmental Procedures Act, the Administrative Procedures Act, the National Forest Management Act, the National Wild and Scenic Rivers Act and any implementing regulations for these statutes.

Kerry White, Executive Board of CBU stated, "the Forest Service failed in their duty to comply with these Acts and regulations and they have left us no choice but to challenge the Forest Service decision in court."

Twenty other individuals, organizations and local government agencies have joined the litigation including the Beaverhead County Commission. The Forest Service failed to coordinate with the County Commission on the Forest Plan revision and they are implementing decisions and actions outside their authority.

"We have continued to try and work with the Forest Service through comments, meetings and our appeal to their decision but we have been ignored" stated Mr. White.

The people that have businesses, ranch operations and leases in and around the Beaverhead Deerlodge National Forest depend on multiple use access and the Forest Service is closing a very large portion of this forest to the general public. The Beaverhead County Commission, concerned with the economic impact these closures will have on their local communities, have joined in this action.
