he ought to have known that injury or bodily harm could have happened. maybe they should sue him for being there and not being prepared for the conditions. thats whats wrong with the world, nobody wants to take responsibility for thier actions. imagine a avalavche happening at a hill shootout, what are the odds???? pretty good if you ask me, so if you go i'd say you assume that risk when you open the car door to get out...
 
now i've never actually read my trail pass when in revy, but doesn't it pretty much say procede at your own risk and that the club can not be found at fault for any injury or damage?
 
Personal responsibility for one's actions these days is something many lack.

This is just stupid!! This person maybe shouldn't have been on a sled at all...ever. It's not everyone else's fault if he didn't educate himself, and rides the backcountry.

So if I go snowmobiling and dont check the avy report and I'm stupid an go climbing big hills with a ton of snow load, and get hert who do I sue?
 
I think it will be a good test to see what the facts really are... there is no denying that at least a couple of the people/organizations benefitted financially from the event and even though they deny 'any' involvement in the event they sure did a lot of 'supporting' of the event.

It will be interesting because it will set boundaries as to what people or organizations can do in 'unofficial' ways to promote an event. I'll be curious to see what facts are brought out.

I do wonder about naming the climbers as plantiffs... casting a wide net I suppose.

Crazy BUT he could win support in court. And those that say they didn't organize it might have a tough time proving that it's actually NOT their names as sponsors on the fliers that were passed out...pretty sure it was posted on here if I remember right.

Not supporting this guy, just my .02.

What really bothers me is that in his lawsuit he is sueing one of the guys who died. Like the family really needs this bs now. I can't see it even getting to court but you never know. Maybe they will use this case as a steeping stone to help further the no snowmobiling in the backcountry.

It would change a lot of things if he should win. It would impact a lot of things that take place in the backcountry.

The real lesson here is that if you leave your house you need a good insurance policy. Did he have one? That was the first thing my wife had me do once our first kid came along.

Not enough info in this article to get the real story. Seems to me he was one of the spectators watching. Easy for all the keyboard warriors to condem this person and his family, with only a smidge of info. Sounds to me that he and his son and his family have been to hell and back. JM2C

Don't need alot of info to see some people take no personal responsiblity. It's in all walks of life. Some people feel the need to blame everyone else when things go bad.
 
Responsibility for what? You dont know anything about his circumstances nor do I.. BUT. Maybe he was out riding Revy for the day with his son and came across this event, stopped for lunch to watch and these guys burried him and his son. Who knows... but it is a bit disturbing that peeps on this site can so quickly judge a person that they do not know and who has had serious life changing injuries based off of a couple paragraph news article. Brutal comes to mind

We will have to see what the outcome is. I just hope that this is not some lawyer taking advantage of an injured man and making bull**** promises to him just to make a buck.

still doesn't change the fact that he should have been aware of what the avalanche danger was, and that he was parked eating his lunch in a dumb spot.
 
I don't think it will go far in court. As I recall the "event" was already over for the day and some people chose to go on to Turbohill...at that point they are on their own. Even if it was part of the "event", they were free to leave at any time or park in a safer location. Warnings are everywhere up there!! Did THEY (those suing) check the conditions or were THEY the neglegent party? Unbelievable :face-icon-small-dis

lets say i was out near an MX park and decided to have a picnic next to the end of a 200' landing, lets say the guy balls it up on the landing and his bike smashed my face in....whos fault would that be? mine:light:

Responsibility for parking where he parked. Responsibility for not having looked at avalanche risk in the area ( his lawsuit says because he's incompetent it's everyone elses responsibility to inform him) Responsibility for accepting the fact that sometimes things happen. I'm surprised he didn't sue the province for allowing the hill to be there.

I'm sure they have been to hell and back, but what do you think the families of the decieced have been doing over the last year? having a ****ing picnic? and now they are being sued.... I have plenty enough info to decide for myself this guy and his lawyer are a pair of bottom feeding scum suckers.

Maybe the club or the CAC should counter sue him for ignoring the warnings and endangering the life of a minor....
